A COMPARATIVE ANALYSIS OF JUDICIAL BENCH COMPOSITION BETWEEN THE COURTS OF THAILAND AND SINGAPORE: EXAMINING STRUCTURAL DIMENSIONS, SELECTION MECHANISMS, TENURE SECURITY, AND JUDICIAL INDEPENDENCE

Judicial systems in Southeast Asia lack rigorous comparative analysis of judicial bench composition across structural dimensions and de facto judicial independence. This study aims to 1) comparatively analyze judicial bench composition between Thai and Singaporean courts across five key dimensions, and 2) synthesize a judicial bench flexibility model explicating the relationship between bench flexibility and judicial system efficiency in the Southeast Asian context. A qualitative functional comparative legal methodology (Zweigert & Kötz, 1998) was applied, analyzing primary sources including constitutions, statutes, and relevant regulations, alongside secondary sources published during 2021–2026. Findings indicate that Singaporean courts possess significantly greater bench flexibility than Thailand through international judge and judicial commissioner mechanisms not yet present in Thailand. Thailand's judicial recruitment operates primarily through the Judicial Commission of the Courts of Justice, whereas Singapore confers joint roles upon the Prime Minister, President, and Chief Justice. Although both jurisdictions constitutionally guarantee judicial independence, Thailand faces comparatively greater concerns regarding political interference. The synthesized model comprises five variables: judicial role diversity, tenure flexibility, recruitment openness, bench-size adjustment mechanisms, and internationalization. This model demonstrates that enhancing bench flexibility without diminishing judicial independence safeguards can elevate systemic efficiency and institutional legitimacy. Policy recommendations for Thailand include adopting international judge mechanisms within specialized courts and reforming judicial recruitment processes toward greater transparency.
