Legal Liability for Posting Defamatory Content About Others

Abstract
This academic article aims to study legal liability related to posting defamatory content about others on social media. The scope of the study covers the concept and characteristics of defamatory posting, applicable civil and criminal laws including defamation, aggravated defamation by publication, and sexual harassment offenses under the Criminal Code, as well as specific laws including the Computer-Related Crime Act B.E. 2550 (2007), amended B.E. 2560 (2017), and the Personal Data Protection Act B.E. 2562 (2019), along with comparative foreign law, particularly the Republic of Singapore. The study found that Thai laws applicable to defamatory postings are complex due to multiple overlapping statutes, yet lack comprehensive coverage in certain cases, particularly sharing images or publishing personal identification information of others (Doxing), for which no specific provisions exist, resulting in difficulties in effective enforcement. This article proposes amendments to establish specific legal provisions concerning liability for defamatory postings, making the law more appropriate, clear, and effective in protecting victims in the digital era.
